October 15, 2024 – Marielise Kelly successfully defended Martha’s Vineyard Transit Authority (“MVTA”) against an appeal by the Amalgamated Transit Union, Local 1548 to the Commonwealth Employment Relations Board (“CERB”). CERB affirmed a finding of no probable cause entered by a Massachusetts Department of Labor Relations [DLR”] Investigator and affirmed the dismissal of all charges of prohibited labor practices including refusal to bargain and/or regressive bargaining against MVTA. CERB upheld the DLR Investigator’s determination that MVTA was not a joint or single employer of public transportation bus drivers who were employees of an independent transportation company.
