Barnstable Superior Court, Civil Action No. 1972CV00638, 1/26/23 (Buckley, J.). In this case, plaintiff had accepted a ride as a passenger in defendant’s tow truck, after sustaining a flat tire. When she went to exit the cab of the tow truck, she missed a step and fell, sustaining personal injuries. She claimed defendant was negligent, as its operator did not assist her in exiting the truck.
